If you file your tax return late, the IRS may impose a failure-to-file penalty. For returns filed after the due date (including extensions), the penalty is usually 5% of the unpaid tax for each month or part of a month that the return is late, up to a maximum of 25%. The penalty starts accruing the day after the tax filing due date. Refer to IRC Section 6651(a)(1) for more details. As per the 2025 rates, the failure-to-file penalty can be as high as 25% of the unpaid tax for returns over 60 days late.
